General Terms and Conditions of Sale
Article 1 – Purpose
These terms and conditions govern the sales of products by Domaine Saint Firmin, RUE SAINT FIRMIN, 30700 UZÈS.
Article 2.1 – Prices
The prices of our products are stated in euros, inclusive of all taxes (VAT and other applicable taxes on the order date), unless otherwise specified, and exclude handling and shipping costs.
For orders shipped outside mainland France, you are considered the importer of the relevant product(s). Customs duties, local taxes, import duties, or state taxes may be applicable.
These duties and charges are not the responsibility of Domaine Saint Firmin. They are at your expense and fall under your sole responsibility, both in terms of declaration and payment to the competent authorities and bodies in your country. We recommend that you check with your local authorities regarding these matters.
All orders, regardless of their origin, must be paid in euros.
Domaine Saint Firmin reserves the right to modify its prices at any time. However, the product will be invoiced based on the rate in effect at the time the order is confirmed, subject to availability.
Products remain the property of Domaine Saint Firmin until full payment is received.
Important: As soon as you take physical possession of the ordered products, the risk of loss or damage is transferred to you.
Article 2.2 – Delivery Fees
The minimum order quantity is 6 bottles.
Free shipping is available for orders of €180 or more within mainland France and €240 or more to other European countries.
Shipping rates for 2025:
– 6 bottles to France: €18
– 6 bottles to Europe: €23
Article 3 – Orders.
You can place an order: Online: https://en.saint-firmin.com Contractual information is presented in French and will be confirmed at the latest upon validation of your order. The company Domaine Saint Firmin reserves the right not to record a payment and not to confirm an order for any reason, particularly in the event of supply issues or difficulties concerning the received order.
Article 4 – Order Validation.
Any order placed on the website https://en.saint-firmin.com implies acceptance of these General Terms and Conditions. Confirming an order signifies full and unconditional acceptance of these terms, without exception or reservation. All provided data and recorded confirmation shall serve as proof of the transaction. You acknowledge full awareness of this.
Order confirmation shall be considered as a signature and acceptance of the completed transactions. A summary of your order details and these General Terms and Conditions will be sent to you in PDF format via the confirmation email of your order.
Article 5 – Payment.
By validating your order, you commit to paying the indicated price. Payment for purchases is made by credit card via a secure system. Your card will only be charged upon shipment of your order. In case of split deliveries, only the dispatched products will be charged.
Article 6 – Withdrawal.
In accordance with Article L. 121-16 of the Consumer Code, you have the right to return the product, at your expense, to our headquarters’ address specified in Article 1, within fourteen days (Hamon Law of June 13, 2014) from delivery, for exchange or refund, provided the product is in good condition and in its original packaging with the original invoice. You are responsible for any damage the product may suffer during this process, which may invalidate your right of withdrawal. Return costs are your responsibility. If the right of withdrawal is exercised, the company Domaine Saint Firmin will refund the amounts paid within 14 days of your request notification, using the same payment method as the original transaction.
EXCEPTIONS TO THE RIGHT OF WITHDRAWAL In accordance with Article L.121-21-8 of the Consumer Code, the right of withdrawal does not apply to: The provision of fully performed services before the end of the withdrawal period, if execution has started after the consumer’s express prior agreement and waiver of the right of withdrawal. The supply of goods or services whose price depends on market fluctuations beyond the trader’s control and which may occur during the withdrawal period. The supply of goods made to the consumer’s specifications or clearly personalized.
The supply of goods that may deteriorate or expire rapidly. The supply of goods unsealed by the consumer after delivery and which cannot be returned for hygiene or health protection reasons. The supply of goods which, after delivery and due to their nature, are inseparably mixed with other items. The supply of alcoholic beverages whose delivery is deferred beyond thirty days and whose agreed value at contract conclusion depends on market fluctuations beyond the trader’s control.
The supply of audio or video recordings or computer software unsealed by the consumer after delivery. The supply of newspapers, periodicals, or magazines, except for subscription contracts to these publications.
Transactions concluded at a public auction. The supply of digital content not provided on a physical medium, if execution has started after the consumer’s express prior agreement and waiver of the right of withdrawal.
Article 7 – Availability.
Our products are offered as long as they are visible on the website https://en.saint-firmin.com and within the limits of available stock. For non-stocked products, our offers are valid subject to availability from our suppliers. If a product is unavailable after you place an order, we will notify you by email. Your order will be automatically canceled, and no bank debit will occur. Additionally, the website https://en.saint-firmin.com does not intend to sell products in large quantities. Therefore, the company Domaine Saint Firmin reserves the right to refuse orders for multiple identical items.
Article 8 – Delivery.
Products are delivered to the address provided during the order process, within the timeframe specified on the order validation page. In case of shipping delays, you will be notified via email about any potential impact on your delivery date. According to legal provisions, in case of delivery delays, you may cancel the order under the conditions defined in Article L 138-2 of the Consumer Code.
If you receive the product in the meantime, we will process a refund, including shipping costs, under the conditions of Article L 138-3 of the Consumer Code. In case of delivery delay, the company Domaine Saint Firmin cannot be held responsible if the delay is solely due to the customer’s unavailability after multiple delivery attempts.
Article 9 – Guarantee.
All our products are covered by the legal warranty of conformity and the warranty against hidden defects, as stipulated in Articles 1641 and following of the Civil Code. If a sold product is non-compliant, it may be returned, exchanged, or refunded. All claims, exchange, or refund requests must be made by email within 30 days of delivery.
Products must be returned in their original condition, with all elements (accessories, packaging, instructions, etc.). Shipping costs will be refunded based on the invoiced rate, and return costs will be reimbursed upon submission of proof. These provisions do not affect your right of withdrawal as stated in Article 6.
Article 10 – Liability.
The products offered comply with current French legislation. The company Domaine Saint Firmin cannot be held liable for non-compliance with the laws of the country where the product is delivered. It is your responsibility to verify with local authorities whether the products or services you intend to order comply with local regulations.
Article 11 – Governing Law and Disputes.
The language of this contract is French. These terms and conditions are governed by French law. In case of dispute, French courts shall have exclusive jurisdiction.
Article 12 – Intellectual Property.
All elements of the website https://en.saint-firmin.com remain the intellectual and exclusive property of Domaine Saint Firmin. No one is authorized to reproduce, exploit, redistribute, or use any elements of the website, whether software, visual, or audio, for any purpose, even partially. Any simple or hypertext link is strictly prohibited without prior written consent from Domaine Saint Firmin.
Article 13 – Personal Data.
The company Domaine Saint Firmin reserves the right to collect personal information and data about you. They are necessary for order management and for improving the services and information we provide to you. They may also be shared with companies that contribute to these relationships, such as those responsible for order execution, processing, and payment management.
These data are also stored for security purposes, to comply with legal and regulatory obligations. In accordance with the French Data Protection Act of January 6, 1978, you have the right to access, rectify, and object to your personal data. You can exercise this right directly on the website.
Article 14 – Archiving and Proof.
The company Domaine Saint Firmin archives order confirmations and invoices on a reliable and durable medium constituting a true copy in accordance with Article 1348 of the French Civil Code.
The computerized records of Domaine Saint Firmin shall be considered by all concerned parties as proof of communications, orders, payments, and transactions between the parties.
